Nevada state law requires all drug and device manufacturers doing business in Nevada to complete its Marketing Code of Conduct Annual Filing Form (previously referred to as AB128). Completed forms are due June 1st annually, and may be emailed to the Nevada State Board of Pharmacy.
Nevada Certification Requirements
Nevada's Marketing Code of Conduct Annual Filing Form asks each company to confirm that regular compliance training is being conducted, compliance policies and procedures have been deployed, and a compliance officer has been identified. This year, the form has been updated to include more detailed questions about specific topics within the company's compliance policies (e.g., speaker programs, consultants, gifts, grants), and you must also submit the company's marketing code of conduct.
Upon submission, the Nevada State Board of Pharmacy also requires a signed certification that an "annual audit to monitor compliance with the company's marketing code of conduct for the above-named company has been completed and the company is in compliance with the marketing code of conduct." The marketing code of conduct refers to the practices and standards which govern the marketing and sale of the company's products (e.g., AdvaMed Code, PhRMA Code). The company's Compliance Officer must sign the certification. If you have not completed your annual compliance audit, now is the time to complete one so your Compliance Officer can confidently certify this requirement.
