What's On File Could Be On Trial: Mastering Documentation Risk

May 06, 2025

A two-part webinar series exploring how documentation practices can make—or break—your legal defense in regulatory and litigation settings

This 2-part series will explore the case law around the proper retention of documents for litigation, proper attorney client privilege and confidentiality practices, as well as how to reduce the number of potentially damaging documents in the companies files, which may be used against it in litigation.

  • In Session 1, Documenting with Discipline: Legal Foundations and Best Practices, Gardner Law Senior Counsel David Graham will discuss how proper documentation practices can help ensure that the company can tell its story completely in any regulatory or court proceeding and help the company efficiently manage information to best serve its business purposes.
  • In Session 2, The Files Strike Back: When Bad Documentation Undermines Good Companies, David will explore real life examples of bad documentation practices damaging companies' legal arguments and provide practical takeaways to avoid the same fate. You will leave these sessions with a clearer understanding of how to structure documentation policies that protect privilege, reduce litigation risk, and support your company’s narrative in both regulatory reviews and court proceedings.
